SARASOTA, Fla. (WWSB) – Attorneys for Brian Laundrie’s parents have filed an updated 21-page motion to dismiss Gabby Petito’s lawsuit
The Laundries explained that their choice to remain silent during Gabby’s disappearance is “what most people would and should do”.
Gabby Petito’s parents sued Laundries for intentionally inflicting emotional distress earlier this year. Gabby’s parents claim that the laundries knew that Brian had murdered Gabby and were trying to help him get out of the country and were taking steps to block all communication with the Petito family.
Laundries attorney Steven Bertolino released a statement that reads:
“The Amended Complaint did not confirm, ‘declare,’ any new facts or cite any law that would support the claim without legal basis. We are confident that our current motion to dismiss the Amended Complaint will be granted. »
Bertolino argued that the Laundry’s decisions to speak only to their attorney during Gabby’s disappearance were “legally authorized, constitutionally protected, not outrageous, and do not give rise to any cause of action”, and that the suit would be dismissed.
The lawsuit seeks damages of at least $30,000 and if not dismissed, a jury trial has been set for the week of August 14, 2023.
