Zakay Law Group, APLC and JCL Law Firm, APC File Lawsuit Against Blend Labs, Inc. (“Blend Labs”) Alleging Non-Payment of All Wages


The San Francisco labor lawyers, Zakay Legal GroupAPLC and Law Firm JCL, APCfiled a complaint against Blend Labs, Inc., Mix Operations, Inc., Blend Title Insurance Agency, Inc.and Blend Insurance Agency, Inc. (collectively, hereinafter, “Mixing laboratories“) for allegedly failing to provide employees with meal and rest breaks in accordance with the law. Mixing laboratories prosecution, Case No. CGC-22-600420, is currently pending at San Francisco County Superior Court of the State of California. A copy of the complaint can be read here.

The lawsuit alleges Mixing laboratories violated the Private Attorneys General Act (“PAGA”), which gives rise to civil penalties due to Blend Lab’s conduct. PAGA allows aggrieved employees to take legal action to recover civil penalties on behalf of themselves, other employees and the state of california for violations of the labor code. An “aggrieved employee” is defined as “any person who was employed by the alleged infringer and against whom one or more of the alleged violations were committed”. Cal. Laboratory. Section 2699(c) of the code. PAGA allows aggrieved employees to become “supplemented” as private attorneys general to enforce the Labor Code.

The lawsuit further alleges that due to their work schedules, Mixing laboratories employees would have been unable to take meal breaks and were not fully relieved of duty during meal periods. Specifically, the lawsuit alleges that the employees were occasionally interrupted during their meal breaks to complete tasks for Mixing laboratories. The employees would have been required to carry out the work ordered by Mixing laboratories for more than five (5) hours during a shift without being granted a meal break outside working hours. In addition, the lawsuit alleges Mixing laboratories failed to provide employees with a second meal period outside of working hours on each working day on which such employees were required by Mixing laboratories work ten (10) hours of work. Employees would therefore have lost meal breaks without additional compensation and in accordance with Blend Lab’s strict policy and practices.
